The agreement
These terms are between you and Kirby Chan Digital, which runs Kirbify. By opening or using an account you agree to them.
Your account
You are responsible for the people you add to your account and for keeping sign-in details private. Tell us at once if you think someone else has got in.
Your information
Everything you put into Kirbify stays yours. You can download all of it at any time. We use it only to provide the service, as the privacy policy describes.
Messaging rules
You may message only people who have agreed to hear from you, as the law where they live requires (in Canada, CASL; in the United States, the TCPA and CAN-SPAM). Kirbify checks recorded consent before sending, but you are responsible for the consent you record being true. Accounts used for spam are closed.
What you may not do
Break the law with it, send unsolicited bulk messages, upload material you have no right to hold, try to get into another account, or resell the service without our agreement.
Payment
The plan is billed monthly in advance through Stripe. If a payment fails, automated follow-up pauses until it is settled; your information stays available. You can cancel at any time and the account stays open until the end of the period paid for.
Availability
We work to keep Kirbify running and your information safe, and we back it up. The service is provided as it is, without a guarantee that it will never be interrupted.
Liability
To the extent the law allows, our liability to you for any claim is limited to what you paid us in the twelve months before it arose. We are not liable for lost profit or for the content of messages you send.
Ending the agreement
You can close your account at any time. We may suspend or close an account that breaks these terms, and will say why. On closing, you have 30 days to download your information.
Law
These terms are governed by the laws of Ontario, Canada.
